David B. Kosakoff is an accomplished litigator and trial lawyer. Since graduating from Hofstra University School of Law in 1987, Mr. Kosakoff has concentrated in the area of professional liability defense, primarily representing design professionals including architects, engineers, and land surveyors.  He serves as the head of K&C’s Insurance Defense practice. Mr. Kosakoff has more than 35 years of experience handling a wide variety of complex construction claims.  He has extensive trial experience involving a variety of matters ranging from simple disputes to complex matters with damages exceeding $30 million. He has also written and argued numerous appeals in both State and Federal Appellate Courts. Mr. Kosakoff is admitted to practice law in the State and Federal Courts of New York and New Jersey.

In addition, Mr. Kosakoff has extensive experience addressing disputes through alternative dispute resolution.  He has participated in a considerable number of mediations and arbitrations both as a litigator and neutral.  He serves as a mediator on the Construction Panel of Mediators for the American Arbitration Association and as an arbitrator on the Construction Panel of Arbitrators for the American Arbitration Association.  Mr. Kosakoff has also been appointed to serve on the Commercial Panel of Mediators for the Nassau County Supreme Court and the Commercial Division ADR Panel for the New York County Supreme Court.  He is available to serve as a mediator and can be engaged directly.  His experience as a mediator and arbitrator provides a unique perspective on the thought process of a judge presiding over cases, a skill which he utilizes effectively in evaluating claims.

Mr. Kosakoff is well known to design professionals in the New York Metropolitan area.  He is a frequent lecturer and author of articles on various topics of interest to the design community and serves as General Counsel to the Long Island Chapter and the Westchester/Hudson Valley Chapter of the American Institute of Architects. He is also one of a select group of lawyers in the country to be designated a LEED Accredited Professional by the Green Building Certification Institute, having attained this honor based on knowledge of environmentally sensitive construction projects.
